Partner Stacy E. Cozart has been practicing immigration law since 2000 and has built a reputation as one of the foremost experts in the field. She is currently the Ohio Chapter Chair for the American Immigration Lawyers Association and has recently been selected by her peers for inclusion in The Best Lawyers in America 2016 in the field of immigration law.

For over 15 years partner Michael M. Jolic has been working in the field of immigration law. Prior to her retirement, co-founder Anikó T. Kálnoki practiced immigration law for approximately 20 years. DACA Update (September 6, 2017)

This week the Trump administration announced that it will end Deferred Action for Childhood Arrivals (or “DACA”). Under the program, people who came to the United States as children and met several key guidelines would not face deportation for two years, a period which could be renewed. Immigrants who were approved would also be eligible for work authorization. Since 2012, nearly 800,000 DACA recipients have received approval to go to school and work legally in the United States.

The immediate fallout from this announcement is that the USCIS has stopped processing any initial DACA applications effective September 5, 2017. USCIS will continue processing applications already accepted prior to September 5, 2017. Applications for renewal filed by DACA beneficiaries whose status expires between September 5, 2017 and March 5, 2018 will be processed provided these applications are submitted to USCIS and accepted on or before October 5, 2017. Applications for DACA renewal received by USCIS after October 5, 2017 will be rejected. USCIS also announced that DACA recipients with lost, stolen or destroyed employment authorization documents may request a replacement through the normal process. All applications for advance parole filed by DACA recipients will no longer be processed and the USCIS will refund advance parole application filing fees for currently pending applications.

Following the most recent action by the Trump administration, DACA’s fate now lies in the hands of Congress, which can choose to act to protect the program within the next six months. President Trump tweeted on Tuesday that he may revisit DACA if Congress fails to act. Sharon & Kalnoki will continue to monitor DACA developments.
